Terms of service
These terms apply to bookings made through this site with G.K. Lee Photography, based in Magnolia, Arkansas. Every booking is also governed by the Booking Policies & Client Agreement, which you read and sign as part of the booking form. Where these terms and that agreement differ, the signed agreement controls.
What is sold here
This site sells creative services: photography, videography, content creation, and related add-ons. Nothing physical is sold or shipped. Prices shown are base prices; travel, rush editing, studio, last-minute and other add-on charges may apply and are shown before checkout where they are selected.
Booking and payment
- A signed agreement and a non-refundable retainer of fifty percent (50%) of the agreed service fee are required to hold a date.
- The remaining fifty percent (50%) balance is due on or before the session date.
- Final photographs, video, and other deliverables are not released until all amounts owed have been paid in full.
- Sessions booked within five (5) days of the requested date may be subject to a last-minute booking fee.
- Travel fees may apply for services outside the local service area.
- Additional services, hours, locations, participants, or deliverables requested after booking may result in additional charges.
Consultation and scheduling
A consultation is required for applicable sessions and should be completed at least twenty-four (24) hours before the session date where reasonably possible. Deadlines, venue restrictions, and other requirements should be communicated as early as possible; delays caused by information shared after the session cannot be the photographer's responsibility.
Rescheduling requires at least seventy-two (72) hours' notice. Late arrival reduces available shooting time and does not extend the scheduled end time.
Deliverables
Editing is performed at the photographer's artistic discretion unless specific requirements are agreed in writing. RAW, unedited, or source files are not included unless agreed in writing. Delivery timelines vary by package, scope, season, and workload; rush delivery may be available for an additional fee where the schedule permits.
Copyright and how images may be used
Copyright in all photographs and video remains with G.K. Lee Photography. Clients receive a personal-use license to the delivered images — printing, sharing, and posting them personally. Commercial use, resale, and licensing to third parties require a print release or commercial usage agreement, which can be purchased as an add-on.
Delivered images should not be edited, re-cropped, filtered, or altered in ways that misrepresent the original work.
Portfolio use
Unless agreed otherwise in writing before the session, photographs and video created during a booking may be used in the photographer's portfolio, website, social media, advertising, and promotional materials. If you would prefer your images not be used this way, say so in writing before your session and that will be respected.
Where a booking involves other people, the client is responsible for obtaining any permissions from participants that are the client's responsibility to obtain.
Accuracy of what you give us
You are responsible for the accuracy of the details submitted at booking — name, contact details, dates, location, and the description of what you want. Incorrect details can affect scheduling, travel pricing, and delivery.
Limitation of liability
Reasonable precautions are taken to protect equipment and to perform services professionally. The photographer is not responsible for missed coverage, lost or corrupted files, delays, or incomplete work caused by circumstances beyond reasonable control, including venue restrictions, interference by attendees, weather, equipment failure despite reasonable precautions, unsafe conditions, or emergencies.
To the extent permitted by law, liability arising from a booking is limited to the amount actually paid for that booking. Indirect, incidental, consequential, and speculative damages are excluded except where that exclusion is prohibited by law.
Governing law
These terms are governed by the laws of the State of Arkansas.
Changes
These terms may be updated from time to time. The terms in effect at the time of your booking are the ones that apply to it.
