Client Agreement

This Agreement applies to photography, videography, content creation, and related creative services provided by G.K. Lee Photography (“Photographer”) to the booking client (“Client”).

By signing this Agreement, submitting a retainer or payment, or otherwise confirming a booking after being provided access to this Agreement, Client acknowledges that Client has had the opportunity to review these terms and agrees to be bound by them.

1. Booking & payment

A signed Agreement and a non-refundable retainer of fifty percent (50%) of the agreed service fee are required to secure a session, shoot, event, or production date unless otherwise agreed in writing.
The remaining fifty percent (50%) balance is due on or before the scheduled session, shoot, or event date.
Photographer is not required to deliver final photographs, videos, edited content, or other deliverables until all amounts owed under this Agreement have been paid in full.
Travel fees may apply when services are provided outside Photographer’s local service area.
Sessions, shoots, or events booked within five (5) days of the requested service date may be subject to a last-minute booking fee.
Rush editing, expedited delivery, or other accelerated services may be subject to additional fees.
Any additional services, hours, locations, deliverables, equipment, or production requirements requested by Client after booking may result in additional charges.

Equipment damage

Client is not automatically charged any equipment or gear-damage fee simply because equipment is present at a session, shoot, or event.

If Photographer’s equipment, gear, cameras, lenses, lighting equipment, computers, storage devices, stands, accessories, or other property is damaged, lost, destroyed, or rendered unusable during the time Photographer is providing services, Client agrees to be responsible for the reasonable cost of repair or replacement when the damage, loss, or destruction is caused by Client, Client’s guests, attendees, employees, representatives, vendors, contractors, or other persons under Client’s responsibility or control.

If the damage or loss is caused by a third party who is not under Photographer’s control, Client agrees to reasonably cooperate with Photographer in identifying the responsible party and in seeking payment or reimbursement for the resulting damage or loss. Where necessary, Client agrees to assist Photographer in arranging a reasonable method for the responsible costs to be paid or recovered.

Any equipment-damage charge will be based on the actual reasonable repair or replacement cost and will only be assessed if damage, loss, or destruction actually occurs. Photographer will not charge Client an equipment-damage fee merely because equipment was used or present during the service.

2. Client consultation & planning

A phone or other agreed consultation is required for applicable sessions and should be completed at least twenty-four (24) hours prior to the scheduled service date whenever reasonably possible.
During the consultation, Photographer and Client may discuss session goals, creative direction, inspiration, desired poses, locations, outfits, props, schedules, shot lists, video concepts, and overall style preferences.
Client is responsible for communicating all known deadlines, required deliverables, venue restrictions, location requirements, and other important production information to Photographer as early as reasonably possible.
Client acknowledges that Photographer cannot be responsible for delays or limitations resulting from information that was not communicated before or during the service.
Failure to complete a required consultation may result in the session being rescheduled based on Photographer availability.
Any major changes to the session concept, location, timing, number of participants, production requirements, or deliverables requested after booking may be subject to additional fees.

3. Rescheduling & cancellations

Client may request to reschedule a session or production with at least seventy-two (72) hours’ notice.
Retainers may be transferred to a new date at Photographer’s discretion and subject to Photographer’s availability.
A requested new date is not guaranteed until confirmed by Photographer.
Failure to appear for a scheduled session or event without adequate notice may result in forfeiture of payments made.
Client arrival delays may reduce the amount of available shooting time. Photographer is not required to extend the scheduled end time because of Client’s late arrival.
Photographer is not responsible for missed content resulting from Client’s late arrival, failure to provide required access, unavailable subjects, venue restrictions, or other circumstances outside Photographer’s reasonable control.

4. Weather policy

Outdoor sessions may be rescheduled when Photographer reasonably determines that weather conditions create an unsafe or impractical working environment.
Photographer and Client will make reasonable efforts to select an alternative date when possible.
Weather-related decisions concerning safety and equipment protection remain at Photographer’s discretion.

5. Force majeure & unforeseen events

Photographer shall not be considered in breach of this Agreement when Photographer is unable to fully perform services because of circumstances beyond Photographer’s reasonable control, including but not limited to illness, injury, severe weather, natural disasters, governmental restrictions, emergencies, pandemics, acts of terrorism, venue closures, transportation disruptions, utility failures, unexpected location shutdowns, emergency evacuations, public safety incidents, active or threatened violence, shootings, police activity, or other unforeseen circumstances that make continued performance unsafe or impractical.

When reasonably possible, Photographer may attempt to reschedule or continue services at a later time or location.

If circumstances require Photographer to stop or leave a session, shoot, or event for safety or other circumstances beyond Photographer’s reasonable control after services have already begun, the Client remains responsible for the agreed balance for the booked services, subject to the terms below.

Photographer will provide Client with the photographs, video footage, or other content that was successfully captured up to the point services were discontinued, subject to the normal editing and delivery terms of the selected package.

If Photographer and Client mutually agree after the interruption to meet at a later date to continue filming or photography, the parties may agree in writing to a continuation date and any additional time, travel, production, or other applicable fees.

6. Safe working environment & right to discontinue services

Photographer has the right to refuse, pause, suspend, or discontinue services whenever Photographer reasonably believes that continuing would create a threat to personal safety, equipment safety, legal compliance, or a reasonable ability to perform the contracted services.

Circumstances may include, but are not limited to:

Harassment, threatening behavior, violence, or discrimination.
Unsafe locations or working conditions.
Illegal activity occurring at or around the session or event.
Active or threatened shootings or other violent incidents.
Police activity, emergency response, evacuations, or unexpected shutdowns.
Venue or location conditions that become unsafe or inaccessible.
Individuals interfering with Photographer’s ability to safely perform services.
Conditions that place Photographer, Client, attendees, assistants, or equipment at unreasonable risk.
Any circumstance that Photographer reasonably believes requires immediate departure from the location.

Photographer is not required to remain at a location or continue working after determining that doing so would present an unreasonable safety risk.

If Photographer must discontinue services because of a safety concern or an unforeseen event after services have begun, the Client remains responsible for the remaining agreed balance for the booked services, provided Photographer has already commenced performance and subject to any applicable written agreement between the parties.

Photographer will make reasonable efforts to preserve and deliver usable content captured before services were discontinued. For video services, this includes usable video footage captured before Photographer was required to leave. For photography services, this includes usable photographs captured before Photographer was required to leave.

The Client understands that Photographer cannot guarantee replacement footage, photographs, or a continuation date when circumstances require Photographer to leave for safety reasons.

If both parties later agree to continue the production, the parties may arrange a separate continuation date and determine in writing whether any additional fees apply.

7. Image & video delivery

Photographer retains artistic discretion regarding photography and video editing unless specific requirements are agreed upon in writing.
RAW, unedited, or source files are not included unless specifically agreed to in writing.
Final delivery timelines may vary depending on the selected package, project scope, season, workload, revisions, and other production factors.
Client is responsible for communicating required deadlines before the service date.
Rush delivery may be available for an additional fee when Photographer’s schedule permits.
Additional edited photographs, video clips, revisions, or other deliverables may be purchased when offered.
Photographer is not responsible for delays caused by circumstances outside Photographer’s reasonable control.

8. Model & content release

Unless Client and Photographer agree otherwise in writing before the session or event, Client grants Photographer permission to use photographs and video created during the contracted services for Photographer’s portfolio, website, social media, advertising, educational purposes, promotional materials, and other lawful business purposes.

Client represents that Client has obtained any necessary permissions or releases from individuals participating in the production when such permissions are the Client’s responsibility.

9. Limitation of liability

Photographer will take reasonable precautions to protect equipment and perform services professionally. However, Photographer shall not be responsible for missed photographs, missed video, corrupted or lost files, delays, or incomplete coverage caused by circumstances beyond Photographer’s reasonable control, including but not limited to venue restrictions, interference by attendees, weather, power or equipment failure despite reasonable precautions, unsafe conditions, emergency situations, unexpected shutdowns, or other circumstances outside Photographer’s control.

To the extent permitted by applicable law, Photographer’s liability arising from this Agreement shall be limited to the amount actually paid by Client under the applicable booking.

Photographer shall not be responsible for indirect, incidental, consequential, or speculative damages arising from the services or inability to complete services, except where such limitation is prohibited by applicable law.

10. Late booking & contract acceptance

Any booking, reservation, payment, retainer, deposit, or other confirmation of services made within twenty-four (24) hours of the scheduled session, shoot, event, or service date constitutes Client’s acknowledgment that Client has received access to this Agreement and has had the opportunity to review its terms before confirming the booking.

By proceeding with the booking after receiving access to this Agreement, Client expressly agrees to be bound by all applicable terms, including payment obligations, cancellation and rescheduling policies, late-booking fees, equipment-damage provisions, safety provisions, delivery terms, limitations of liability, and other policies contained herein.

The shortened booking timeframe does not waive or modify any provision of this Agreement unless Photographer expressly agrees to such modification in writing.

Client’s electronic signature, physical signature, payment, retainer, written confirmation, or other affirmative confirmation of the booking after receiving access to this Agreement constitutes Client’s acceptance of these terms.

For bookings made within twenty-four (24) hours of the scheduled service, Photographer may require Client to affirmatively acknowledge this Agreement before services begin.

11. General agreement

This Agreement represents the terms governing the services agreed upon between Photographer and Client. Any changes, additions, or exceptions to this Agreement should be made in writing and agreed upon by both parties.

If any provision of this Agreement is determined to be unenforceable, the remaining provisions shall remain in effect to the extent permitted by applicable law.

Client acknowledges that Client has had the opportunity to review this Agreement, ask questions regarding its terms, and obtain independent legal advice before signing.

By signing or otherwise affirmatively accepting this Agreement, Client acknowledges and agrees to the terms stated above.

How you sign

You accept this Agreement on the booking form. Ticking the agreement boxes and typing your full legal name as your electronic signature, together with your retainer payment, constitutes your acceptance of these terms. A copy of what you signed, including the date and time, is attached to your booking record.
